Subrogation (third-party) claims:
Subrogation claims involve a third party, someone other than fellow employees or your employer, who may have caused or contributed
to your injury or illness. The most common subrogation claims involve:
- Defective products (for example, when a machine malfunctions because of manufacturer's defect)
- Negligent acts of others
You have the right to pursue a claim against the party that was at fault. The State Insurance Fund has a right to recover from a
third party benefits paid on your behalf by the Fund. Since each case involves a different set of facts, it is important that you communicate
with the Fund regarding the status of your subrogation case before accepting any settlement offer. If you settle without the State
Insurance Fund's knowledge, you may jeopardize payment of any future benefits for your injury.
